Terms of Service

These Terms of Service ("Terms") govern your use of Tervia ("the App"), a geopolitical risk monitoring and digital nomad intelligence platform. By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Service Description

Tervia provides geopolitical risk information, tax residency tracking, visa countdown tools, travel route planning, and country intelligence data. The App is designed for informational purposes only to assist travelers and digital nomads.

2. Important Disclaimers

Not Professional Advice

The App does not provide legal, tax, financial, immigration, medical, or travel safety advice. All information, including but not limited to:

  • Tax residency thresholds and calculations
  • Visa requirements and expiry tracking
  • Risk assessments and safety ratings
  • Country intelligence and living data
  • Route planning suggestions
  • Landing kit guides

is provided for informational purposes only and should not be relied upon as a substitute for professional advice. You should consult qualified legal, tax, and immigration professionals for decisions affecting your tax residency, visa compliance, or personal safety.

No Guarantee of Accuracy

Country data, risk assessments, and tax/visa information are based on publicly available sources and algorithmic models. We make reasonable efforts to maintain accuracy but:

  • Information may be outdated, incomplete, or incorrect.
  • Real-world conditions can change rapidly due to political events, natural disasters, or policy changes.
  • Risk scores are estimates based on historical data and models, not predictions.
  • Tax and visa rules are complex and vary by individual circumstances.

We are not liable for any decisions made based on information provided by the App.

No Safety Guarantee

Risk assessments and safety ratings do not constitute a safety guarantee. A country rated as "low risk" may still present dangers. Always exercise personal judgment and consult official government travel advisories.

3. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

4. Accounts

  • You may create an account using Apple Sign In or Google Sign In.
  • You are responsible for maintaining the security of your account and any activity under your account.
  • You must provide accurate information when creating your account.
  • You may delete your account at any time from within the App (Profile > Delete Account). User data is promptly removed from our primary database upon deletion.
  • We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

5. Subscriptions and Payments

Pricing

Tervia offers free and paid tiers (Pro and Sentinel). Current pricing is displayed in the App and on the Apple App Store / Google Play Store listing.

Billing

  • Subscriptions are billed through Apple App Store or Google Play Store.
  • Payment is charged to your Apple ID or Google account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • The renewal price may change; you will be notified in advance of any price increases.
  • You can manage and cancel subscriptions in your device's App Store settings (not within the App).

Free Trial

If offered, free trials automatically convert to paid subscriptions at the end of the trial period unless canceled. Any unused portion of a free trial is forfeited upon purchasing a subscription.

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process payments or refunds directly.

Free Tier

Free users have access to limited features as described in the App. We reserve the right to modify free tier features at any time.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse engineer, decompile, disassemble, or extract source code from the App.
  • Circumvent subscription restrictions or access paid features without authorization.
  • Use automated systems to access the App (scraping, bots, crawlers, etc.).
  • Interfere with or disrupt the App's infrastructure or other users' use of the App.
  • Transmit any malware, viruses, or harmful code.
  • Impersonate any person or entity.
  • Use the App to facilitate tax evasion or immigration fraud.

7. Intellectual Property

  • The App, its design, code, data compilations, algorithms, and content are owned by Tervia and protected by intellectual property laws.
  • Country data sourced from third parties is used under their respective licenses (World Bank CC BY 4.0, Transparency International CC BY-ND 4.0, UNDP CC BY 3.0 IGO, U.S. Department of State Public Domain).
  • You retain ownership of your personal data entered into the App.
  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TERVIA AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Financial losses resulting from tax, visa, or travel decisions made using the App.
  • Personal injury or property damage arising from reliance on risk assessments or safety ratings.
  • Loss of data, revenue, profits, or business opportunities.
  • Damages arising from service interruptions, inaccuracies, or errors.
  • Cost of substitute services.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tervia and its developers, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any decisions you make based on information provided by the App.

10. Binding Arbitration and Class Action Waiver

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Tervia agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration, rather than in court, except that either party may seek equitable relief in court for intellectual property infringement.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

Class Action Waiver

YOU AND TERVIA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to hello@tervia.app within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you wish to opt out.

11. Termination

By You

You may stop using the App at any time. You may delete your account at any time from within the App. Active subscriptions must be canceled separately through your device's App Store settings.

By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination include but are not limited to violation of these Terms.

Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections 2, 3, 7, 8, 9, 10, and 14 survive termination.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet or infrastructure failures, or third-party service outages.

13. Age Requirement

You must be at least 13 years old to use the App. If you are under 18, you represent that you have parental or guardian consent to use the App and agree to these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. To the extent litigation is permitted under these Terms, any action shall be brought in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts. If your jurisdiction has mandatory consumer protection laws that cannot be waived by contract, those mandatory provisions shall continue to apply.

15. Apple and Google Platform Terms

Apple App Store

If you access the App through the Apple App Store, you acknowledge that:

  • These Terms are between you and Tervia, not Apple.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to applicable warranties, Apple's sole obligation is a refund of the purchase price (if any).
  • Apple is not responsible for addressing any claims relating to the App.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
  • You must comply with any applicable third-party terms when using the App.

Google Play Store

If you access the App through Google Play, the Google Play Terms of Service apply in addition to these Terms.

16. Modifications

We may update these Terms from time to time. Changes will be reflected by the "Last Updated" date. For material changes, we will provide notice through the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

17. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tervia.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
  • Headings: Section headings are for convenience only and have no legal effect.
